"Authorities have indeed CLEARED Burke"
 
   BlueCrab (a well-known "Burke Did It" theorist) posted:
BR has never been cleared. No one of authority in Boulder has ever said that BR has been cleared and put it in writing to make it official. Melinda and JAR were officially cleared, but neither of the three Ramseys in the house that night have ever been cleared.
The convoluted October 12, 2000 affidavit written by Lin Wood and signed by Alex Hunter does not clear BR. The word "cleared" does not even appear in the text of the affidavit.

I don't know WHO BlueCrab considers an "authority in Boulder" (perhaps no one but him), but I think MOST OF US would consider the following individuals "authorities" throughout the time that this case was actually under investigation:

1. Mark Beckner
2. The DA's office and/or Alex Hunter
3. Michael Kane
4. Steve Thomas

The following excerpts do indeed "clear" Burke, since he is most notably declared "NOT A SUSPECT", "EXCLUDED" and "CLEARED":

The Star, in a short story under the headline "Burke Cleared -- We Were Wrong," said it was "pleased to correct the record" by reporting that Burke Ramsey was not a suspect in the death of his 6-year-old sister Dec. 26, 1996.
Boulder Police Chief Mark Beckner in 1998 said Burke Ramsey was not a suspect. The Boulder district attorney's office last month reiterated that he was not under suspicion in JonBenet's death after some mainstream media picked up the Star's story.

Hunter's spokeswoman said Boulder Police Chief Mark Beckner publicly announced that Burke was cleared about a year ago when he answered a question from a KCNC-Channel 4 reporter. However, that report was not widely broadcast. Channel 4 announced during its 10 p.m. Thursday newscast that the boy is still not considered a suspect.

But three years after a young girl's killing became a media sensation, one thing hasn't changed: No one has been arrested for killing JonBenét Ramsey.

One thing is clear, however: Burke didn't do it.
In May, The Star tabloid ran a story saying sources in the D.A.'s office believed the boy, then 10, had killed his sister in a fit of jealousy.

Days later, Boulder D.A. Alex Hunter's office made a rare comment about the investigation, declaring in a public statement that the boy, now 12, is not a suspect.

Kane said prosecutors were outraged by the story. "This was a little kid. We just thought it was terrible,'' Kane said.

As the story began to be picked up by more mainstream media, "When the New York Post picked it up, when MSNBC started to run with it, we just thought, "Shouldn't we put this to rest,' '' Kane said.
Kane, the father of two, said, "I considered it to be child abuse, to profit that way'' at the expense of a young boy. And, he said, there was "no basis for the story.''

In his review of evidence, Kane said, "I just didn't see anything to support that'' theory.

Asked recently if Burke had ever been a suspect, Police Chief Mark Beckner said, "Everybody was a suspect in the beginning.''
But, Beckner said, none of the evidence they collected pointed to the boy.

Number Eight – MICHAEL KANE
Michael Kane: The police investigation, contrary to what Mr. Wood said in the little clip you just showed, the police investigation never excluded anybody with the exception of Burke Ramsey from the focus of the case.

As Lin Wood said, he didn't need to be "cleared" because he wasn't even a suspect. Burke has been declared:
1. not a suspect
2. cleared
3. excluded

Hunter in interview with Larry King

KING: Burke was cleared, right?

HUNTER: Yes.

KING: Was he a long-time suspect?

HUNTER: No.

KING: The son?

HUNTER: No, he -- no. He was considered, as you would expect.

KING: Anybody in the house.

HUNTER: He was one of three people in the house. But both Chief Beckner and I spoke to the exclusion of Burke.

   In its December 12, 1999 edition, the Harrisburg Patriot News published an article about Michael Kane, the grand jury prosecutor in the investigation into the murder of my daughter. Mr. Kane was quoted as follows:

"One of the more horrendous mistakes by the media", Kane said, "was the story by a supermarket tabloid, The Star, that branded, Burke, as the killer." Earlier this month, the Ramseys filed a $25 million libel suit against the paper. Kane recalled that when the story first came out last May, it troubled the prosecution. And when the story began getting picked up by other newspapers, they knew they had to do something.

"Alex Hunter and I decided there was no basis for that speculation and no evidence to support it, and we issued a press release to put it to rest," Kane said. "I think it's horrible that a 12 year old kid would have a finger pointed at him with no evidence to support it and have to see his picture on the cover of tabloids every time he's in a supermarket saying that he killed his sister."

403.02
Children Under Ten Years of Age
(1)
Children under 10 years of age cannot be held for a crime.
(2)
Children under 10 years of age taken into custody in the course of a criminal investigation will be:
a.
Taken home to their parent or guardian.
b.
Left at their homes in the custody of a responsible relative 12 years of age or older.
c.
Placed in shelter if no parent, guardian or responsible relative 12 years of age or older is available.
(3)
When a juvenile offender under 10 years of age is taken home, the officer shall, using DPD Form 75, Request to Appear, order the parent or guardian to appear with the child at the appropriate bureau, section or unit if the offense is other than an ordinance violation.
(4)
Juveniles taken into custody for ordinance violations who are less than ten years of age will be handled according to Section 403.02(2)a., b., or c. and not ordered-in to any investigative bureau, section or unit. The Juvenile Case Summary will be completed in detail and forwarded directly to the Juvenile Records Unit, Property Crimes Bureau.
In the narrative portion of the Juvenile Case Summary, list the parents’ names, addresses, phone numbers and the school/grade the child attends.

On the Juvenile Case Summary, the "Referred to Juvenile Court" box will be checked "No" and the "Reason for Non-Referral" box will be checked "Other", with the printed notation, "Under 10 Years Old". The box "Exceptionally Cleared" will be checked.
(6)
Distribution of copies of the Juvenile Case Summary.
a.
No copies need to be made if the offense is an ordinance violation.
b.
For charges other than ordinance violations, two copies of the Juvenile Case Summary will be left at or sent to the appropriate investigative bureau, section or unit by inter-department mail.
